Soluţionarea alternativă a litigiilor de malpraxis medical în Republica Moldova

Abstract

Summary. Alternative dispute resolution technics in medical malpractice litigation in the Republic of Moldova. In this paper are discussed the alternative dispute resolution (ADR) technics in medical malpractice litigation. In the Republic of Moldova is adopted the „fault system” which represents a tort litigation system. Therefore, patients are compensated when in the judicial framework is proved the negligence of the healthcare providers to be the cause of the injury. The defining characteristics of ADR technics in medical malpractice litigation determine that implementation of these extrajudicial methods will have a positive impact on the management of medical malpractice in the Republic of Moldova.

Резюме. Альтернативные методы разрешения споров в сфере медицинской халатности в Республике Молдова В этой статье обсуждаются альтернативные методы разрешения споров (АМРС) в сфере медицинской халатности в Республике Молдова. В Республике Молдова компенсация пациента осуществляется, когда в суде доказывается халатность медицинских работников. Определяющие характеристики АМРС в сфере медицинской халатности доказывают, что внедрение этих внесудебных методов будет иметь положительный эффект как для пациентов, так и для медицинских работников.
