Unele contradicţii etico-legale în managementul sistemului de sănătate publică din perspectiva respectării drepturilor fundamentale ale omului

Abstract

The Public Health System assumes the social responsibility for the general health of the population. At the same time, progresses made in medicine, the fact that medical practice is of higher risk, have accentuated the importance of supplementary guarantees of individual rights of the patient versus interests and benefits of the society. In the article that follows it is analyzed the conflict between the communitarian interests and individual rights from the perspective of the fundamental human rights protectiion, as well as solutions are recommended for a correct ethics-legal management of the Public Health System of the Republic of Moldova.

Sistemul de sănătate publică îşi asumă responsabilitatea socială pentru sănătatea generală a populaţiei. În acelaşi timp, progresele făcute în medicină, faptul că practica medicală a devenit mai riscantă, au accentuat importanţa unor garanţii suplimentare ale drepturilor individuale ale pacienţilor vis-a-vis de interesele şi beneficiile societăţii. În articolul ce urmează este analizat conflictul dintre interesele comunitare şi drepturile individuale, din perspectiva respectării drepturilor fundamentale ale omului şi cu recomandarea unor soluţii pentru un management corect etico-legal a sistemului de sănătate publică din Republica Moldova.
