Aspecte bioetice privind protecţia datelor personale şi confidenţialitatea pacienţilor cu boli transmisibile în era digitalizării

Abstract

Introducere. Digitalizarea sistemelor medicale accentuează provocările legate de protecţia datelor personale. În cazul pacienţilor cu boli transmisibile, riscul real de stigmatizare publică asociată diagnosticului impune o analiză bioet-ică riguroasă a dreptului la confidenţialitate, demnitate şi autonomie. Scop. Studiul analizează, din perspectivă bio-etică, respectarea confidenţialităţii datelor pacienţilor cu boli transmisibile în contextul reglementărilor şi practicilor medicale actuale. Material şi metode. Studiul a utilizat o analiză calitativă a literaturii ştiinţifice disponibile în baze de date precum PubMed, Scopus şi Web of Science, vizând lucrări publicate în perioada 2010-2024, inclusiv articole ştiinţifice, ghiduri OMS şi reglementări etice internaţionale privind protecţia datelor pacienţilor cu boli transmisibile. Rezultate. Analiza literaturii de specialitate a evidenţiat dificultăţi recurente în protejarea datelor pacienţilor cu boli transmisibile, în special în contexte epidemiologice unde volumul datelor medicale creşte constant şi impune un grad ridicat de vigilenţă în respectarea normelor etice. Studiile consultate indică lipsa unor protocoale clare privind confidenţialitatea, mai ales în situaţii de urgenţă medicală. Totodată, se remarcă necesitatea formării personalului medical în etica informaţiei şi elaborarea unor recomandări aplicabile în practica clinică, care să permită echilibrarea interesului public cu drepturile individuale ale pacientului. Concluzii. Studiul subliniază importanţa respectării drepturilor pacienţilor şi a confidenţialităţii datelor în gestionarea bolilor transmisibile, evidenţiind necesitatea unui echilibru etic durabil între interesul sănătăţii publice şi obligaţia morală de a respecta şi proteja viaţa privată a fiecărui pacient.

Introduction. The digitization of medical systems accentuates the challenges related to personal data protection. In the case of patients with communicable diseases, the real risk of public stigma associated with the diagnosis imposes a rigorous bioethical analysis of the right to confidentiality, dignity and autonomy. Objective. The study analyzes, from a bioethical perspective, the adherence to confidentiality of data belonging to patients with infectious diseases within the context of medical regulations and practices. Material and methods. The study employed a qualitative analysis of scientific literature available in databases such as PubMed, Scopus, and Web of Science, focusing on works published between 2010 and 2024, including scientific articles, WHO guidelines, and ethical regulations regarding the protection of data of patients with infectious diseases. Results. The analysis of the specialized literature revealed recurring challenges in protecting the data of patients with communicable diseases, especially in epidemiological contexts where the volume of medical data is constantly increasing, requiring a high level of vigilance in complying with ethical standards. The reviewed studies highlight the lack of clear confidentiality protocols, particularly during medical emergencies. Moreover, there is a need to train medical staff in information ethics and to develop comprehensive and applicable clinical guidelines that ensure a fair balance between public interest and individual patient rights. Conclusion. The study emphasizes the importance of respecting patients’ rights and data confidentiality in the management of communicable diseases, highlighting the need for a sustainable ethical balance between the public health interest and the moral obligation to respect and protect each patient’s privacy.
